Future Assurance Text Messaging Privacy Policy (SMS/MMS)

This Text Messaging Privacy Policy ("Policy") governs your use of text messaging services (SMS and MMS) provided by Future Assurance ("we," "us," or "our") through futureassurance.org. By opting in to receive text messages from us, you agree to be bound by this Policy.

1. Overview

"Text Messaging" includes Short Message Service (SMS) messages and Multimedia Message Service (MMS) messages (collectively, "Text Messages"). This Policy supplements our general Privacy Policy and Terms of Service and applies specifically to our text messaging communications.

2. Service Description and Limitations

2.1 Best Efforts Basis. Our Text Messaging Service is provided "as is" on a "best efforts" basis. We utilize third-party telecommunications providers and wireless carriers to deliver Text Messages to recipients.

2.2 No Delivery Guarantee. The Text Messaging Service may not be available on all devices or through all wireless carriers. We cannot and do not guarantee that Text Messages will be delivered, nor can we guarantee delivery timing or quality of service. Text Messages may be subject to transmission delays or interruptions.

2.3 Right to Modify or Terminate. We reserve the right to modify, suspend, or terminate the Text Messaging Service at any time, with or without notice, except as required by applicable law.

3. Your Consent to Receive Text Messages

3.1 Opt-In Requirement. Before sending you any Text Messages, we must obtain your express written consent (opt-in). By providing your mobile phone number and agreeing to receive Text Messages from Future Assurance, you:

  • Confirm that you are the account holder or have authorization to use the provided mobile number

  • Consent to receive automated text messages at the phone number provided

  • Understand that consent is not a condition of purchase

  • Agree that message and data rates may apply based on your mobile carrier's plan

3.2 Types of Messages. You may receive the following types of Text Messages from us:

  • Transactional messages (confirmations, updates, reminders)

  • Account notifications and alerts

  • Service-related updates

  • Marketing and promotional messages (if you opted in to receive them)

  • Customer service communications

3.3 Message Frequency. Message frequency varies depending on the type of messages you've opted in to receive. You may receive up to [specify frequency, e.g., "4 messages per month" or "messages may be sent daily during active promotions"].

3.4 Scope of Consent. Your consent applies only to Future Assurance and only to the specific message types you agreed to receive. We will not share your consent with other companies or use it to send messages for purposes other than those you explicitly agreed to.

4. 10DLC Campaign Registration and Compliance

4.1 Campaign Registry. To deliver Text Messages to mobile phone users in the United States, we register our messaging campaigns with The Campaign Registry (TCR), as required by major U.S. wireless carriers for 10-digit long code (10DLC) messaging.

4.2 Compliance Measures. We maintain compliance with 10DLC requirements by:

  • Registering our business brand with The Campaign Registry

  • Registering each messaging campaign for carrier approval

  • Adhering to carrier-imposed message volume limits

  • Monitoring deliverability and compliance metrics

  • Maintaining proper consent records

4.3 Potential Service Impacts. Failure to comply with 10DLC requirements may result in:

  • Message blocking or filtering by carriers

  • Reduced message delivery rates (throttling)

  • Suspension or termination of messaging capabilities

  • Additional carrier fees or penalties

5. Consent Records

We maintain records of your consent to receive Text Messages for at least four (4) years or as required by applicable law. These records may include:

  • The date and time you provided consent

  • The method by which consent was obtained (web form, point of sale, etc.)

  • The specific campaigns or message types you consented to

  • Your mobile phone number

  • Confirmation messages sent to and received from you

We may be required to provide proof of your consent to wireless carriers or regulatory authorities upon request.

6. Your Rights and Choices

6.1 How to Opt-Out. You may revoke your consent and stop receiving Text Messages at any time by:

  • Replying "STOP," "END," "CANCEL," "UNSUBSCRIBE," or "QUIT" to any Text Message

  • Contacting us at info@futureassurance.org

  • Following opt-out instructions provided in the messages

After you opt-out, you will receive one final confirmation message, and then no further messages will be sent unless you opt-in again.

6.2 Help Information. For assistance, reply "HELP" to any Text Message or contact us at 502-205-9500.

6.3 No Opt-Out Evasion. We will honor all opt-out requests promptly and will not use our Text Messaging Service to evade your opt-out preferences.

7. Prohibited Content and Acceptable Use

7.1 Legal Compliance. We will only send Text Messages that comply with all applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and state consumer protection laws.

7.2 Prohibited Content. We will not send Text Messages containing:

  • Illegal content or content promoting illegal activities

  • Fraudulent, deceptive, or misleading information

  • Phishing attempts or social engineering schemes

  • Malware, viruses, or malicious links

  • Hate speech, harassment, or discriminatory content

  • Content designed to evade spam filters

  • High-risk financial services (payday loans, debt collection, credit repair)

  • Cannabis, CBD, or illegal substances

  • Gambling promotions

  • Work-from-home schemes or high-risk investment opportunities

  • Age-restricted content without proper age verification

7.3 Sender Identification. All Text Messages will clearly identify Future Assurance as the sender.

7.4 No URL Shorteners or Redirects. We avoid using URL shorteners and redirects in our messages, as these may be blocked by carriers.

8. Privacy and Data Protection

8.1 Information Collection. When you opt in to receive Text Messages, we collect:

  • Your mobile phone number

  • Consent records and timestamps

  • Message delivery status and engagement data

  • Any information you provide in response to our messages

8.2 How We Use Your Information. We use your mobile phone number and related information to:

  • Send you the Text Messages you requested

  • Maintain compliance with legal and regulatory requirements

  • Improve our messaging services

  • Respond to your inquiries and requests

8.3 Information Sharing. We may share your mobile phone number with:

  • Our telecommunications service providers and wireless carriers (as necessary to deliver messages)

  • The Campaign Registry (for 10DLC compliance)

  • Legal authorities (when required by law or to prevent fraud)

  • No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We do not sell, rent, or share your mobile phone number with third parties for their marketing purposes.

8.4 Data Security. Text Messages are transmitted over wireless networks not under our control. While we implement reasonable security measures, we cannot guarantee the privacy or security of Text Messages transmitted over third-party networks. You are responsible for safeguarding your mobile device.

8.5 Data Retention. We retain your mobile phone number and consent records for as long as necessary to provide the Text Messaging Service and comply with legal obligations, typically at least four (4) years from the date of your last opt-in.

9. Costs and Fees

9.1 Message and Data Rates. Standard message and data rates from your wireless carrier may apply to all Text Messages sent and received. Check with your carrier for details on your messaging plan.

9.2 No Charges from Future Assurance. We do not charge you to receive Text Messages, but your wireless carrier's standard rates apply.

10. Age Restrictions

10.1 Minimum Age. You must be at least 18 years old to provide consent to receive Text Messages from Future Assurance. If you are under 18, you must have a parent or legal guardian's consent.

10.2 Age-Restricted Content. We do not knowingly send age-restricted content to minors. If we discover that we have collected information from a minor without proper consent, we will promptly delete that information.

11. Limitations of Liability

11.1 Service Availability. We are not responsible for:

  • Delays, failures, or interruptions in Text Message delivery caused by wireless carriers or telecommunications providers

  • The availability of the Text Messaging Service in your geographic location

  • Technical issues with your mobile device or wireless service

  • Actions or omissions of third-party service providers

11.2 Content Liability. You acknowledge that:

  • We bear no liability for messages you request or authorize us to send

  • We are not liable for any lack of privacy or security in the Text Messaging Service

  • Text Messages are transmitted over systems not under our control

11.3 Disclaimer of Warranties. THE TEXT MESSAGING SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.4 Limitation of Damages. TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE TEXT MESSAGING SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Anti-Fraud and Spam Prevention

12.1 Scam Prevention. If we suspect that our Text Messaging Service is being used for fraudulent or scam purposes, we may:

  • Investigate the message content

  • Report suspicious activity to carriers and regulatory authorities

  • Block messages or suspend service

  • Cooperate with law enforcement investigations

12.2 Prohibited Techniques. We do not engage in:

  • Spoofing (falsifying caller ID or sender information)

  • Snowshoe sending (distributing similar messages across multiple numbers to evade spam filters)

  • Content designed to evade detection or spam filters

  • Embedding phone numbers that forward to unpublished numbers without clear disclosure

13. Regulatory Compliance

13.1 TCPA Compliance. We comply with the Telephone Consumer Protection Act (TCPA) and related regulations, including obtaining proper consent before sending marketing messages.

13.2 CTIA Guidelines. We follow the CTIA Messaging Principles and Best Practices and the CTIA Short Code Monitoring Handbook guidelines.

13.3 State and Local Laws. We comply with applicable state and local laws governing text messaging and consumer communications.

13.4 Carrier Requirements. We adhere to the terms, policies, and acceptable use requirements of wireless carriers and The Campaign Registry.

14. International Considerations

If you are located outside the United States, additional laws and regulations may apply to Text Messages you receive. We comply with applicable international laws, including but not limited to:

  • The UK's Privacy and Electronic Communications Regulations (PECR) and A2P Code of Conduct

  • Australia's Spam Act 2003 and Communications Alliance codes

  • Canadian Anti-Spam Legislation (CASL)

  • European Union's ePrivacy Directive and GDPR

15. Policy Updates

15.1 Right to Modify. We may update this Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons.

15.2 Notice of Changes. When we make material changes to this Policy, we will:

  • Post the updated Policy on futureassurance.org with the "Effective Date" revised

  • Notify you via Text Message if required by law

  • Provide you an opportunity to opt-out if the changes materially affect your rights

15.3 Continued Use. Your continued participation in the Text Messaging Service after we post changes constitutes your acceptance of the updated Policy.

17. Effective Date and Acceptance

This Policy is effective as of the date posted above. By opting in to receive Text Messages from Future Assurance, you acknowledge that you have read, understood, and agree to be bound by this Policy and our general Privacy Policy and Terms of Service.
